Hope Valley Flasher walks free from crown court 29th January 2014
A pervert who exposed his genitals to a woman and committed sexual offences involving two young girls has been allowed to walk free from Nottingham Crown Court after sentencing last week.
Chesterfield magistrates’ court originally heard on Monday, August 12, how Brian Worthy, 65, of Brentwood Road, Bamford, Hope Valley, admitted committing the offences.
He appeared at Derby Crown Court during proceedings but his case had been repeatedly adjourned until sentencing on January 24, at Nottingham.
District Judge Andrew Davison had told Worthy during the magistrates’ hearing: “The facts are shocking and distressing. It’s disturbing. There were a number of incidents in a short period of time.”
Worthy, who used to work in the pub trade, pleaded guilty to causing or inciting a girl under 13 to engage in sexual activity between June 1 and 5, and guilty to the same offence with another girl on July 17.
He also pleaded guilty to intentionally exposing his genitals to a woman in a park in Bamford on July 2.
Defence solicitor Steve Brint said during the magistrates’ hearing that Worthy’s behaviour was new and needed “nipping in the bud”.
He added Worthy would have struggled to cope in prison. The magistrates’ court had heard how there was no penetration or any actual contact involved. Worthy was sentenced to a three year community order with supervision and was made the subject of a Sexual Offences Prevention Order placing him on a sex offenders’ register

Derbyshire Police and Derbyshire Trading Standards seize More Than 7,000 cigarettes In Joint Raids
Two people have been arrested and tobacco with a street value of £5,000 seized, in the latest raids to crack down on shops suspected of selling counterfeit cigarettes.
Derbyshire Police and Derbyshire County Council Trading Standards officers raided two shops in Park Corner, Ripley and Victoria Street, Shirebrook on Tuesday, January 14th.
More than 7,000 cigarettes and 94 pouches of hand rolling tobacco were seized as well as a number of bottles of suspected illicit vodka.
A specially trained sniffer dog helped find the products at the premises.
A 29-year-old woman and a 32-year-old man have been arrested and released on bail pending further inquiries.
The raids are part of an ongoing joint enforcement campaign to tackle the sale of illicit tobacco in the county.
D/Sgt Mike Nicols, from Derbyshire Police, said: "We continue to work with trading standards and other partners to combat the increase we've seen in this illegal trade.
"We're standing up for legitimate local traders, whose businesses are being damaged by counterfeit and illicit tobacco and alcohol being sold at vastly reduced prices.
"We will continue to act on information passed to us about counterfeit and illegal products being sold in our communities."

County council steps in with funding for Buxton’s Crescent project 27th January 2014
Derbyshire County Council has agreed to loan the developers behind a project to convert Buxton’s Crescent into a 79-bedroom five star spa hotel a multi-million pound sum to secure the future of the scheme.
The Buxton Crescent and Thermal Spa project began a number of years ago when the county and borough councils sought to find a new use for The Crescent – jointly owned by both authorities.
Funding is coming from a variety of sources, the developers (£15m), Heritage Lottery Fund (£12.4m), English Heritage (0.5m) and Derbyshire County Council and High Peak Borough Council (£2m).
The project was due to receive £5m from the East Midlands Development Agency, (EMDA), but this funding was withdrawn when EMDA was disbanded by the Government in 2011. Four recent bids to the Regional Growth Fund (the Government fund which replaced Development Agency grants) have not been successful.
The delay caused by losing the EMDA funding has meant that because of the current financial climate the developers have not been able to borrow the amount they need from the banks. And it is this amount that the council has agreed, in principle, to loan to them. Additional funds are also needed because of increased construction costs.
Cllr Anne Western, Leader of Derbyshire County Council said: “The Crescent is of national historic significance and its restoration will put Buxton and the north of the county back on the map.
“This project is too important to Buxton and the rest of Derbyshire to fail. It is very disappointing that neither the Government or the banks have been able to give their support. Our only option to allow the restoration of the Crescent and in turn create a better economic future for Buxton is to loan the outstanding money ourselves.”

Buxton’s Royal British Legion branch is being relaunched in Buxton Town Centre
27th January 2014
Buxton’s Royal British Legion branch is being relaunched - less than a year after closing - with new premises in the centre of the town. The branch, which folded last May because of dwindling membership, has been reformed with a new committee selected at a meeting held last week.
And after the former branch headquarters on Hardwick Square were closed in April 2012, the branch is close to securing a deal for new town centre premises.
As well as being the location for co-ordinating the town’s poppy appeal from, the new site will be open for members to drop-in for a coffee, chat or advice on a wide range of issues.
Buxton’s Mo Stewart, who served 25 years in the RAF, has been instrumental in the reforming of the branch and the new premises. She said: “This reinvigorates the Legion. You don’t actually have to have served in the forces to be a member.”
She added: “We’re going to hold social events once a month. It is going to be a hub which will raise our profile in the town and it’s going to be a shop window with a big poppy in there too.
“Buxton is very similar to an RAF station, it is a tight-knit community and this is a chance for us to be able to give people somewhere to come to.”

Buxton charity attacks Edwina’s views 26th January 2014
The head of a Buxton food bank has hit out at Edwina Currie’s comments, after she claimed food aid didn’t help people, but instead perpetuated their problems.
Cath Sterndale, who runs High Peak Nightstop, said she “totally disagreed” with the former Tory MP who claimed this weekend that food bank users spent their cash on tattoos and dog food.
Cath, whose service operates from United Reform Church, on Hardwick Square East, said: “Like everything in life, there’s always going to be someone taking advantage. But I’d say that for every 100 people we help, 99 are in genuine need and my main concern is getting help to them.”
Edwina, of Chinley, accused food banks of not providing solutions for users who have long term issues such as alcoholism, tweeting: “Some need real help, not sticking plaster tins of soup.”
Cath responded: “We help maintain a better standard of living while other agencies deal with the other issues, whether they’re unemployed, on probation or an alcoholic.
“It’s intended to be a short, sharp intervention before the relevant agencies intervene. I think it’s essential in every community that we pull together and look after those in dire need. It can take a while for benefits to be arranged. It really infuriates me that people can be in denial.”
Last Saturday, the former junior health minister posted on Twitter: “Food banks don’t solve problems. They just ensure people go on living with problems. For decades.”
On Sunday, she criticised councils for providing food banks with funding, describing it as “crazy” and “a real abrogation of responsibility”.
Cath replied: “Each to their own, but absolutely anybody can find themselves in distress at any time. Food banks cut down on crime too. Users have told us that they would have had to shoplift for food without us, so we’re providing a service to the community.”

A Buxton man who used someone else’s debit card to buy a mobile phone top up was caught out after going to the account holder’s bank and trying to withdraw money, a court heard.
On December 16, Ryan Farrell went to the Santander branch in Buxton where he attempted to withdraw some money using a card belonging to Giles Martin. He told staff he was awaiting a pin number for the card and then gave incorrect answers to the security questions he was asked. Farrell, who had used the card to purchase a £10 mobile phone top-up, was identified by police from the bank’s CCTV and interviewed about the offence on December 18.
The 25-year-old, of Fairfield Road, had earlier admitted fraud by false representation and committing an offence whilst subject to a conditional discharge imposed in October for two counts of theft.
Ian Baker, defending, said: “What little money he has got is being spent on illegal drugs. For 11 years he has been taking drugs.”
Farrell was given a community order with 12 months supervision and a six-month drug rehabilitation requirement.
He must pay £25 compensation to Mr Martin, £85 costs and a £20 surcharge.

Crashed car on New Year’s Day 24th January 2014
A Taddington man who crashed his car in the early hours of New Year’s Day failed to provide a specimen of breath to police, a court heard.
Officers on duty on the A6 at Taddington came across an overturned vehicle just before 1am on January 1, High Peak Magistrates’ Court heard.
They saw Robert Adam Lockyer climbing out of the driver’s side and could smell alcohol on his breath so asked him to provide a roadside breath test, which he refused.
He was taken back to Buxton police station and again refused the test, prosecutor Jennifer Fitzgerald said.
After taking legal advice, he offered to take the test, but was legally unable to do so. He did provide a voluntary sample which had a reading of 75, the legal limit is 35.Lockyer, 25, of Humphrey Gate, admitted failing to provide a specimen.
John Bunting, defending, said: “He lives in Taddington and works as a chef in Buxton. He finishes work at around 9.30pm but the last bus to Taddington is 8.30pm.”
Lockyer was fined £280 and ordered to pay £85 costs and a £28 surcharge. He was also banned from driving for 16 months.

Council refuses plans for 275 homes in Harpur Hill 24th January 2014
Plans for 275 homes on greenfield land in Harpur Hill have been rejected by councillors, to the relief of residents.
Members of the High Peak Borough Council’s development control committee refused Harpur Homes’ application for land at Burlow Road and Heathfield Nook Road at a meeting in Chapel-en-le-frith on Monday. Councillors heard that the proposal referred to two parcels of land and a maximum of 275 houses, of which 83 would be affordable and 27 would be retirement homes.
Plans also included a crèche, a sports pavilion and areas of public open space. Planning officers recommended the committee refuse the application on the grounds that the development would erode an important swathe of open countryside, which contributed towards the rural character of the locality.
They added that the site was in an unsustainable location by virtue of its distance to local amenities and that its detrimental impact on the visual character of the area outweighed the economic and social benefits of the scheme.
High Peak Council received 209 letters of objection, as well as opposition from ward councillors Lynn Stone and Keith Savage.
Natural England also objected to the development stating that it risked causing an increase of phosphate levels in the River Wye, part of a Special Area of Conservation, as a result of an increase in the discharges from the Buxton treatment works.
Philip Dowell, chairman of the Harpur Hill Residents’ Association, told the committee that there was a large brownfield site in the centre of the village, which should be developed before any consideration was given to greenfield sites. Carl Copestake, speaking on behalf of applicant Harpur Homes, said that the council’s housing policies were out of date and that the application should be granted because the site, although greenfield, was poor agricultural land.
Cllr Stone said: “Traffic would have an adverse impact on Heathfield Nook, which would then impact on the residents of Cowdale and King Sterndale.”
Cllr Savage agreed, saying: “The site is part of what is essentially a rural, farming area and to allow such a major development would change the character of the landscape forever.”
Opening the debate, Cllr Lance Dowson opposed the development, saying it would have a life changing effect on residents. Members voted unanimously to refuse the application.

Buxton Man stabbed his dog in ‘frenzied attack’ 23rd January 2014
A Buxton man who stabbed his dog in a “prolonged and premeditated attack” has been spared jail.
Police were called to the flat of Dean Anthony Daly at St James Court, Harpur Hill, just before 8pm on November 5 after being contacted by a neighbour, High Peak Magistrates’ Court heard.
When they arrived, they saw Daly’s dog, a black Labrador called Simba, lay on the sofa. “Daly told them he had lost his temper with the dog after it had bit him so he stabbed it,” prosecutor Jennifer Fitzgerald said. Simba was taken to the vets and examined where his injuries were found not to be life threatening.
In interview, Daly said he had been eating his dinner when he sat down on the settee, sitting on Simba’s paw, which was injured. “He said the dog bit his arm and wouldn’t let go so he punched it but it still wouldn’t let go, so he grabbed the knife from his plate and stabbed the dog in a frenzied attack,” Mrs Fitzgerald added.
Daly admitted he had been drinking heavily on the day in question, the court heard. Simba is now being looked after by a foster family.
Daly, 41, denied causing unnecessary suffering to a protected animal but was found guilty after trial.
John Bunting, defending, said: “This offence was aggravated by the use of a weapon. There are issues with the defendant’s mental health. He has previously attempted suicide. Whilst remanded in custody on this case he self harmed further.”
He added: “We do know in relation to this dog that it had previously bitten the defendant. On the morning of this incident it had bitten the defendant on the thumb. It had again bitten him prior to this incident.
“He was taken to hospital by police for treatment to injuries to his left arm. “There is no callous neglect over a long period of time. Something flared up that day. “This dog means a lot to the defendant. His flat is full of pictures of the dog with the defendant out walking.”
Chairman of the bench Hilary Batterbee said: “This was a prolonged and premeditated attack with a weapon on a dog and that attack had the potential to cause very serious injuries.”
Daly was given 20 weeks in prison, suspended for 18 months. He must comply with a supervision requirement for 18 months and attend a programme with the probation service for 60 days. He was deprived of ownership of Simba and banned from owning, keeping or participating in the keeping of animals for five years, and must pay £250 costs and an £80 surcharge.

Later in the afternoon 25 members of the joint Buxton and Edale Teams Snatch Squad were called to Mam Nick Car Park, near Castleton, and Chapel Gate, following a report of an injured walker, thought to be on Rushop Edge.
The location was later changed to The Tipps Car Park, near Edale, when the position of the casualties was made clearer.
The team located a 44 year old male from Urmston, Manchester, who had suffered lacerations to a leg from a buried broken bottle when he sank into a peat bog near to Brown Knoll. He was treated on site by a Edale team paramedic, packaged and placed onto a stretcher.
Team members moved him via Edale Cross, Jacobs Ladder, and arrived at The Tipps Car Park in the dark. The casualty was transferred to the waiting land ambulance and taken to the Stepping Hill Hospital, Stockport for treatment.
